Compensation of Victims of Grave Human Rights Violations in the Light of the Experience of Tunisian Transitional Justice :Legal approach to the implementation of the mechanisms of reparation and rehabilitation.
ملخص:
تتشكل التعويضات وفق مقاربة دولية من خلال عدة مبادئ أساسية تتجلى في رد الحقوق للضحايا وفقا لوضعيتهم الأصلية من خلال مختلف الحقوق المدنية والسياسية والاقتصادية، والتعويض الذي يقوم وفق الضرر الذي لحقه بنفسه وذويه، وإعادة تأهيلهم من خلال برامج الرعاية الطبية والنفسية والقانونية، وترضيتهم بشكل يتلاءم مع حاجياتهم وحاجياتهم وذوي الضحايا، بالقيام بإعادة دفن الرفات وتقديم اعتذار رسمي من قبل ممثلي الدولة، وضمان عدم تكرار الانتهاكات الجسيمة لحقوق الإنسان في المستقبل من خلال الاصلاحات المؤسسية ومنه قطاع الجيش والأمن واستقلال القضاء.
وترتيبا على هذا، اعتمدت التجربة التونسية مقاربة قانونية تكتسي أهمية استثنائية وفريدة على مستوى تجارب لجان الحقيقة، باعتمادها مساطر قانونية وأنظمة توضيحية و إجرائية للجنة جبر الأضرار ورد الاعتبار لإنصاف ضحايا الانتهاكات الجسيمة لحقوق الانسان، الشيء الذي يخلق انسجام وإنصاف الضحايا على قدم المساواة وفق هذه الاجراءات القانونية الواضحة.

Abstract:
Compensation is based on an international approach through several basic principles that are reflected in the return of rights to the victims according to their original status through various civil, political and economic rights, and compensation which is done according to the damage inflicted on himself and his family, And rehabilitate them through programs of medical, psychological and legal care, and provide them in a manner appropriate to their needs and needs and the families of the victims, To undertake the reinterment of the remains and to provide an official apology by the representatives of the State, and to ensure that gross violations of human rights are not repeated in the future through institutional reforms, including the military, security and judicial independence sector.
Accordingly, the Tunisian experience adopted a legal approach that is of exceptional and unique importance at the level of the experience of the truth commissions by adopting legal and illustrative procedures and procedures for the Commission on Reparations and Rehabilitation to redress the victims of gross violations of human rights, Which creates harmony and equity for victims on an equal basis in accordance with these clear legal procedures.
